Minister Irimescu: the risk of infringement for the law for the commercialisation of food is kept in the case of Romania

The risk of infringement for the law for the commercialisation of food is still for Romania, as the European Commission did not agree with our interpretation of the short acquisition supply chain, stated on Friday the minister of agriculture, Achim Irimescu.

‘The risk of infringement exists, but not definitely, as it is to see what is going to happen (…) You know that infringement happens after two years of discussion. As the future parliament intends to amend the law, let us hope that a solution is going to be found to avoid any infringement. The law is applied at the moment, but it doesn’ t function wholly as there are no application norms’ Irimescu says.

The minister of agriculture must come with the norms for the law 150/2016 regarding the commercialisation of food in six months since the putting to practice of the document, 15 January 2017 respectively.

Fresh food as well as frozen and processed will come on the short supply chain which involves commercial relations between the supplier, one trader and consumers, according to the draft of Government decision which establishes the methodological norms for the law 150/2016 for the commercialisation of food published on 12 December on the site of MADR.

The draft of the document says that the supplier in the short-supply chain is accordingly the farmer, the farmer and a physical entity or judicial entity with the activity of collection and/or storage of the products; farmer and a physical entity or judicial entity with the activity of collection and/or storage and process of the products. The trader in the short-supply chain is the physical person or judicial person who has the activities included in the government ordnance no.99 of 29 August 2000 regarding the commercialisation of the products and the market services with the amendments to come.

The provisions of the present decision are applied for the meat produce ( pork, chicken, lamb, goat, beef, fish) for eggs ( all categories); for vegetables (potato, beans, green beans, onion, garlic, carrot, celery, cabbage, cucumber, tomato, eggplant, lettuce, broccoli, cauliflower, mushrooms, zuchinni, peas, corn, leek) fruit (pears, plums, peaches, apricots, cherries, sour cherries, grapes, melons, raspeberries, strawberries, nuts, blackberries, nuts) for honey ( all kinds) for dairy products (all products) for bakery ( all types of bread and bakery products).
