A new law would restrict the right to notify CCR

The Chamber of Deputies (Romanian Parliament’s lower chamber) has adopted on Wednesday a draft law initiated by Social Democrat MP Florin Iordache that establishes a deadline of 15 days the most for which the Parliament’s resolutions can be referred to the Constitutional Court.

The Chamber of Deputies passed Iordache’s draft law by 168 votes to 91 and three abstentions.

The bill is completing the Law 47/1992 on the organization of the Constitutional Court. In the current form of the law, there is no deadline for which CCR could be notified.

Liberal deputy Gabriel Andronache said the draft law is restricting the right to file an appeal to the Constitutional Court, while USR MP Stelian Ion announced the Union would challenge the bill to the constitutional judges.

In retort, the initiator Florin Iordache argued that a previous CCR ruling says that establishing deadlines only aims at bringing more discipline to the laws.

„The way you challenge laws and tease gives the Government the right to submit ordinances. It’s not possible to wait for some decisions for years just because you are in the mood of referring them to the Court,”, Iordache said.
