Consultations on justice laws at the Cotroceni Presidential Palace: PSD doesn't agree to resume the legislative process related to the justice laws
PSD doesn't agree to resume the legislative process related to the justice laws, since we have Ordinance 92 in Parliament, the leader of the party, Liviu Dragnea, said at the end of the consultations held between the Social Democratic Party (PSD) representatives and President Klaus Iohannis at the Cotroceni Palace, headquarters of the presidential administration.
"It was a relatively calm talk, during which Mr. President told us his opinion related to the justice laws, in the sense that the legislative process should be resumed. However, we don't think this would be necessary, for we have Ordinance 92 in Parliament, in the case of which parliamentary procedures were already initiated and which includes a large part of the recommendations of the Venice Commission, an ordinance that was proposed to the Government by Minister Toader, after the meeting he had in Strasbourg with experts of the Venice Commission. We have never refused to talk about the justice system in Romania. On the contrary, this was an assumed objective, for we already decided in 2016 not to make the mistake against to pretend we do not see what happens in Romania, to pretend that we do not see the abuses we were exposed to, unfortunately, and some Romanian citizens are still facing such abuses by a part of the justice laws in Romania. We cannot pretend there are no secret protocols, which are unconstitutional agreements, illegal, toxic that, in fact, have fueled the building of such occult organisations, which fed from important state institutions and blocked a part of the justice system in Romania," stated Dragnea at the end of consultations on the justice laws President Iohannis had with the PSD delegation at the Cotroceni Presidential Palace.
În his opinjon, the head of state, Klaus Iohannis, cannot get involved in the parliamentary activity and cannot play the role of a mediator between the political parties.
The PSD leader specified that the Social Democrats did not come to consultations to make a commitment in front of Iohannis. "We did not come to make a commitment with the President (...), we just understood that he wanted us to take into account the recommendations of the Venice Commission," said Dragnea. He added that they already considered the recommendations, as an emergency ordinance has been approved recently in the justice field, which will become law in Parliament.
"The European Parliament has no reason to adopt any resolution against Romania, absolutely no proper reason," Dragnea stated, when asked if he is concerned by the possibility that the European Parliament adopts a resolution against our country.
Liviu Dragnea led the PSD delegation that participated on Wednesday at the Cotroceni Presidential Palace in the consultations convened by President Klaus Iohannis on the legislation in the Justice area.
Finally, the negotiating team of the Social Democratic Party (PSD), major at rule, that on Wednesday attended negotiations with President Klaus Iohannis offered Iohannis a list of 10 principles "for real judicial independence and respect for the rule of law," PSD national leader Liviu Dragnea said at the end of the talks.
Among the principles passed on to the Iohannis are those regarding respect for the Constitution of Romania in its letter and spirit, including the provisions regarding the statutes of prosecutors and judges; halting the abuse of justice against citizens and removing the effects it has generated; respect for the fundamental human rights guaranteed by the Constitution of Romania and international treaties, such as the right to defence and the right to a fair trial, the presumption of innocence, the right to privacy and the inviolability of the secret of correspondence; guaranteeing the independence of judges who dispense justice both from the political environment and from any other form of pressure exerted by prosecutor's offices or intelligence services.
Other principles aim to secure the independence of prosecutors in building cases, in accordance with the constitutional principle of hierarchical subordination; the accountability of magistrates for bad faith and serious negligence in fulfilling their duties; ousting the magistrates who have collaborated with intelligence services and implemented secret protocols by violating the constitution and laws in force; guaranteeing judicial independence from any interference by the intelligence agencies; the principle of celerity in building and solving criminal and civil cases; the principle of meritocracy and moral and professional probity in the promotion of magistrates to higher offices of the judiciary.
The PSD team was made up of PSD national leader Liviu Dragnea and lawmakers Robert Cazanciuc, Florin Iordache, Serban Nicolae and Eugen Nicolicea.
