Law enacted: Asylum seekers can stay in Romania until the procedure is completed

President Klaus Iohannis promulgated on Wednesday the law approving the GEO which provides that asylum seekers can stay in Romania until the procedure is completed.

Thus, applicants for this form of protection have the right to remain in Romania until the asylum procedure is completed. In the case of the procedure for determining the Member State responsible for examining the asylum application, the right to remain in Romania ceases on the date of the transfer.

The emergency ordinance was issued including in the context of the operationalisation context starting with 7th March 2023 of the Schengen Information System.

Similarly, the government mentioned, one year ago, when the normative document was issued, the conflict in Ukraine and the massive flow of displaced persons which ‘led to an exponential growth of the requests for protection lodged on the national territory, followed by the admittance of temporary protection for more than 80,000 people, which determined the personnel of the General Inspectorate for Immigration to be under significant pressure. This made necessary the support of experts from the European Union Asylum Agency and the Operational Support Plan for Romania was signed’.
