RWEA requires the intervention of premier Victor Ponta in the activity of the Department for Energy

The Romanian Wind Energy Association(RWEA)requiers the intervention of premier Victor Ponta to define the mechanisms meant to ensure the legislative predictibility in the domain of energy, according to a press release from RWEA.


‘As a result of the new draft of governmental decision through which the number of green certificates will be reduced earlier than 1 Janaury as it was included in the law, once it will be published in the Official Gazette, the RWEA requires the direct intervention of the premier Victor Ponta to define the mechanisms meant to ensure the legislative predictibility without which the Romanian public policies can’t get the trust of the investment environment. RWEA expresses its amazement for the energy policy promoted by the minister for energy Constantin Nita’ the press release shows.

According to the executive director of the Association Ionel David the recalculation of the number of green certificates in part of the game imposed by the Romanian legislation and the agreement with the EU, but the date is the one that worries the wind energy industry of Romania.

‘What worries the whole wind energy industry in Romania is the date when they want to apply the new regulation, immediately after the publication of the government decision in the Official Gazette and not starting with January 2014 in line with the provisions of Law 220-2008 regarding the renewable technologies and the agreement with the EU’ Ionel David said.

According to the press release, to legitimate the decision, minister Constantin Nita mentions, among others, the commitments taken by Romania in March 2013 following the negotiations with DG Competition, the General Department for Competition of the EU.
David says that in June, DG Competition sent a letter to the Romanian authorities to draw their attention that any alterations to the law of energy must be notified initially to the EC and it is unfair that EC would approve amendments in the draft law which modify the law.

The minister of economy launched in public debate a draft decision which includes the fact that renewable energy producers who will be accreditated after the coming into effect of the present law will receive fewer green certificates. In the presentation of the law, they say that the decision will be applied starting with the moment of approval and publication in the Official Gazette, although the ANRE which monitored the market, proposed the reduction of the certificates starting with January 2014.

The draft includes the reduction by 0.7 green certificates per MWh for microhydropower stations which will receive only 2.3 green certificates for the new power stations and only for the renewed ones. In the case of wind farms, the number of certificates is reduced by 0.5 certificates in 2017 and 0.25 certificates starting with 2018. As a result, the new investorswill benefit from only 1.5 certificates by 2017 and 0.75 certificates starting with 2018. The reduction is even higher as regards the photovoltaic energy. The number of certificates is reduced by 3, so that producers will receive only 3 green certificates against 6.

The draft law initiated by the ministry of economy comes as a result of the ANRE recommendation which monitored the market along last year and reached the conclusion there was an overcompensation, namely the producers get too many certificates by comparison to their cost. The initiators of the draft law argue that, after the reduction of certificates, the contribution of the end users for energy will be reduced for production of energy from renewable sources.
They calculated the impact of green energy in the bill. So, the accreditation of 100 MW photovoltaic installations with 3 green certificates for each MWH produced and delivered, instead of 6 with the capacity factor 16% and the price of the green certificae of 45 euro leads to a life duration of 15 years and the reduction of the contribution paid by users by almost 95 million euro.

The accreditation of 100 MW wind installations by 1.5 and 0.75 green certificates respectively starting with 2018 for each MWh produced and delivered, instead of 2 and 1 respectively green certificates, with capacity factor of 25% and the price of the green certificate of 45 euro, leads to the reduction of the contribution paid by users by almost 47 million euro.
