Magistrates express concern over JusMin Toader statements regarding the activity of prosecutors
More than 200 magistrates have sent a letter to Justice Minister Tudorel Toader, expressing concern over his recent statements regarding the activity of prosecutors.
The signatories also express their surprise at Toader's decision to initiate the assessment of Romania's Attorney General Augustin Lazar.
"We, the undersigned, prosecutors and judges, in compliance with the principle of the separation of powers and the obligation of discretion incumbent on magistrates, have taken note with concern of your statements concerning the activity of magistrates, stripping the Public Prosecution Service of its constitutional role, as well as the recent announcement of the unannounced start of the assessment of the attorney general. Using this opportunity, the prosecutors who are signatories of this letter are hereby expressing their support for the attorney general, Mr Augustin Lazar, as well as for the position of the Prosecution Section of the Supreme Council of Magistrates (CSM) on the disfavours that unsubstantiated assertions about the activity of the entire Public Prosecution Service can bring to the system of justice as a whole," reads the letter.
The signatories believe that the minister's statements on the judicial system can do harm both domestically and internationally. The magistrates are urging Toader to "constructive legal dialogue" to find out the best solution to ensure a judicial system that is at the service of the citizens.
The letter is signed by 181 judges and prosecutors from several courts and prosecutorial offices nationwide, as well as by 29 legal trainees.
