Prosecutors’ Association of Romania about CVM: An objective report showing drawbacks
Bogdan Gabor, the president of the Prosecutors’ Association of Romania, said on Thursday that the the Co-operation and Verification Mechanism - CVM report, made public on Wednesday by the European Commission, is an objective one which also mentions a series of drawbacks and the fact that several chapters could be reopened. It is obvious it is not a report which which should rejoice us, on the contrary, it should continue to make us responsible. We must return to a correct dialogue, one in favor of Romania. It is not a positive report, on the contrary, the fact that we clearly discuss the fact that a series of chapters for which Romania worked a lot could reopen is meant to worry us. Firstly, the biggest threats mentioned in the report are attacks against the independence of justice, made by suggestions to modify various laws, make reference to Order 13 and the two proposals to amend laws of justice indicated in the report,” said Gabor at the Superior Council of Magistracy- CSM headquarters.
He also referred to the final Evaluation Report of UN Human Rights Committee which mentions the same attacks to the justice system which may affect democracy in Romania. Moreover they mention direct attacks against magistrates, the judicial system, and even directly against Romania’s prosecutor general (Augustin Lazar) and DNA chief prosecutor (Laura Codruta Kovesi), which could weaken the fight against corruption”, Gabor said.
The prosecutor added that aspects affecting the independence of the justice system, attacks against prosecutors, especially anticorruption ones, attacks against CSM are, from the Association point of view, aspects which make the reform of justice irreversible.
Asked whether, in case the justice laws were modified as discussed in Parliament, prosecutors would be subordinated to politicians, Gabor answered: “There is such a risk”.
