The European Commission follows with extreme worry the latest evolution connected to the disciplinary measures against the Romanian judges

 

The European Commission follows with extreme worry the latest evolution of the disciplinary measures against the Romanian judges stated on Wednesday a spokesperson of the European Commission for Agerpres, saying that ‘ the independence of the judges is an obligation of the member states in accordance with the Treaties and an essential element of the rule of right’.

The Supreme Council of the Magistracy (CSM) whose mission is to defend the independence of the judicial system has the obligation to apply the rules regarding the freedom of expression of the magistrates as regards the organisation and functioning of the judicial system, of the rules applicable in the private life, continued the representative of the community executive.

The reports in the Mechanism for Cooperation and Verification (MCV) expressed, similarly, worry connected to the Judicial Inspection which must be solved. The Commission will continue to monitor carefully this situation – including other cases underway – in the MCV context and the report regarding the rule of right’ added the spokesperson of the EC.

The Section for judges in disciplinary matters of the CSM decided on Monday to exclude from the magistracy  judge Cristi Danilet, Cluj Tribunal for manifestations which he had on several social media. The decision is not final.

Danilet considers that his exclusion from magistracy was decided by CSM for two short films posted last year on TikTok which had no connection with Justice and the magistrate profession, being connected to his private life.
