The Senate: the ordonance for the amendment of the Fiscal Code, passed
The Senate passed on Monday as the first notified chamber with 71 votes ‘ in favour’ and 37 ‘ against’, the draft law for the approval of OUG 79/2017 which refers to the amendments of the fiscal code.
The plenary got the report of the commission for budget through which the ordnance was amended so that the companies which make income up to one million euro have a social capital of minimum 45,000 lei and at least two employees can opt between the tax on profit and the tax for the turnover.
Other amendments included in the report of the commission and adopted by the plenary aim at the increase of the deductability threshold to expenses with interest from 200,000 euro as the government said, at three million euro and the retaining of the respective interest of the gain from gaming.
Similarly, the amendment referring to the ‘ financing of the projects of research-development-innovation has no VAT. The document on the basis of which the payment of the projects is the working situation’.
Senators Nicoleta Dinu (USR) and Florin Citu (PNL) required the support in the plenary of the 60 amendments presented by the opposition and which were not included in the amendments rejected or accepted in the report of the commission for the budget,but their request was rejected by vote in the plenary.
The chairman of the meeting, the social-democrat Claudiu Manda explained that according to the regulation of the senate, in special cases, it is possible to formulate amendments in the plenary.
The liberal Florin Citu considers that OUG as it is now ‘ will mix things up’.
In his turn, senator UDMR Tanczos Barna explained that the successive amendment of the fiscal code ‘ will lead to a total lack of predictability in the domain’.
‘The biggest issue to confront the natural persons and the judicial ones, companies as well as the public authorities is the issue of predictability (…) This is a OUG which has good parts as well as not so good ones. Surely there would be necessary a better preparation and better calculations, so that they can be implemented in a predictable by the companies’ Tanczos Barna said.
