EU Customs Code: over 25 orders required for the implementation on May 1, 2016
Romania's General Customs Directorate (DGV) has drawn up over 25 orders required for the implementation on May 1, 2016, of the EU Customs Code that adds new regulations in the area, DGV Director General Claudiu Ardeleanu told a specialist conference on Wednesday.
Among the supplements to the customs code, Ardeleanu mentioned a new definition of exporters. He said that exporters are defined as persons that have to be settled in the EU and have a right of disposition over goods. "There are difficulties applying this notion. The European Commission itself has tried to refine this notion by issuing specific guides. We hope to solve this aspect by indirect representation," said Ardeleanu.
Another change under the new code come to the support of companies and it regards the right to be heard. "Before taking a negative decision against a business operator, the operator has to be informed and provided time to remedy deficiencies," added Ardeleanu.
He said the fundamental element of modern customs will be the authorised business operators who are extended simplified customs procedures, but their number in Romania is currently unsatisfactory.
On the other hand, Ardeleanu said unitary interpretation of the notions used in customs regulations is very important. "In the past, very many problems from prior inspections were the result of differing interpretations. I would like such interpretation problems to be as small as possible," said Ardeleanu.
Romania is switching to the new Union Customs Code on May 1, 2016 that provides for common, harmonised procedures EU-wide to facilitate trade. Thus, the same rules are applied irrespective of the state where goods are declared; as soon as the customs formalities are met, the goods can freely circulate and be traded anywhere in the EU.
