Chamber of Deputies rejects draft amendments to the Criminal Codes initiated during PSD Gov't
The Chamber of Deputies unanimously rejected on Tuesday the draft amendments to the Criminal Code and the Code of Criminal Procedure initiated during the Social Democratic Party (PSD) government and which were declared unconstitutional by decisions of the Constitutional Court (CCR).
The draft regarding the amendment of the Code of Criminal Procedure and of Law no. 304/2004 on judicial organization was initially adopted by the Chamber of Deputies in 2018, with the High Court of Cassation and Justice, National Liberal Party (PNL), Save Romania Union (USR) and the President of Romania filing unconstitutionality complaints. The CCR has declared several provisions unconstitutional, in relation to the fundamental law and some directives of the European Union.
Parliament resumed the legislative process in order to reconcile the provisions declared unconstitutional and adopted the draft on April 24, 2019. Again, the CCR was notified by PNL, USR and the President, with the Court admitting the objections.
A similar procedure was followed by the draft amendment to the Criminal Code and Law no. 78/2000 for the prevention, detection and sanctioning of corruption.
